Terms and conditions

1. Provider and scope

These terms apply to all contracts between you and Andres Vargas, AmigoSAP – Nachhilfe, Pützbruchstr. 6, 52477 Alsdorf, Germany (“amigoSAP”, “we”). Your contractual partner for the tutoring and coaching services is amigoSAP. By using our website and services you agree to these terms.

2. Services

We offer individual 1:1 tutoring and coaching on SAP topics, mainly online via video conference. You book single sessions or hour packages, which are stored as credit in your account and consumed proportionally when you book an appointment. We are an independent provider and are not affiliated with SAP SE; “SAP” is a trademark of SAP SE.

3. Account and user obligations

A user account is required for bookings. You confirm that you are of legal age or act with the consent of your legal guardians, or – when booking for a company – that you are authorised to represent it. Your details must be accurate and up to date. Access credentials must be kept confidential; you are responsible for activity under your account.

4. Prohibited use

The following are prohibited in particular:

• unlawful use as well as fraud, spam or misrepresenting your identity
• infringement of copyright, trademark or other protected rights
• compromising security, e.g. malware, penetration attempts, scraping
• sharing, copying, reselling or publishing our learning materials, recordings or access credentials
• reverse engineering or circumventing technical restrictions

5. Rights of use and intellectual property

All rights to the website, learning content, materials, software and trademarks remain with us or our licensors. You receive a simple, non-transferable right to use the content within the scope of the booked package for your own learning purposes. For content you send us (e.g. assignments, documents) you grant us a limited right to store and process it as required to deliver the service. You warrant that you hold the necessary rights to such content.

6. Prices, payment and Merchant of Record

The prices stated on the website at the time of the order, including statutory taxes, apply. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles all customer enquiries and returns. Payment, billing, taxes, cancellation and refunds are additionally governed by the Paddle Buyer Terms.

7. Appointments, cancellations and validity of credits

Appointments are arranged through our booking system. Free rescheduling or cancellation is possible up to 24 hours before the start; after that the session may count as used. If we have to cancel an appointment, the credit is fully restored or an alternative date is offered. Hour credits are valid for 12 months from purchase.

8. Withdrawal and refunds

Consumers have a statutory right of withdrawal; details are set out in our refund and withdrawal policy. In addition, we grant a 30-day satisfaction guarantee in accordance with that policy.

9. Availability and warranty

We strive for high availability of our website but cannot guarantee uninterrupted or error-free operation; maintenance and disruptions are possible. We owe professional learning support, but not a specific exam or learning outcome. To the extent permitted by law, further implied warranties are excluded.

10. Liability

We are liable without limitation for intent and gross negligence, fraudulent concealment, injury to life, body or health, and under the German Product Liability Act. In case of slightly negligent breach of essential contractual obligations, liability is limited to the typical, foreseeable damage and in total to the fees paid in the last 12 months. Liability for indirect damages, consequential damages, lost profit or data loss is otherwise excluded.

11. Indemnification

You indemnify us against third-party claims arising from unlawful use of our services, content provided by you, or a breach of these terms.

12. Suspension and termination

We may temporarily suspend access or terminate the contract for cause in the event of a material breach, payment default, security or fraud risk, or repeated or serious violations of section 4. Unused, paid credits will be refunded unless termination is based on fraud or abuse. After termination you may request a copy of your booking data within 30 days; thereafter the data is deleted in accordance with our privacy policy.

13. Changes to these terms

We may amend these terms with effect for the future and will inform you of material changes in good time. If you do not object within a reasonable period or continue to use the services, the changes are deemed accepted.

14. Assignment, force majeure, final provisions

Assigning your rights under the contract requires our consent; we may transfer the contract as part of a business succession. In the event of circumstances beyond our reasonable control (e.g. telecommunications outages, official measures) our obligations are suspended. German law applies, without prejudice to mandatory consumer protection provisions of your country of residence. The place of jurisdiction is, where permitted, Alsdorf or the statutory venue. Should any provision be invalid, the remainder of the contract remains effective.
